South Africa brought a case against Israel under the Genocide Convention at the International Court of Justice: Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel), case 192.

The Court has issued orders indicating provisional measures on 26 January 2024, 28 March 2024 and 24 May 2024. As recorded on the Court's own case page, the case remains in written proceedings and NO final judgment on the merits has been delivered. The most recent listed document is an Order of 21 May 2026 fixing time-limits for the Reply and Rejoinder.

Provisional measures are interim orders; they are not a ruling on whether genocide occurred. This ICJ case concerns state responsibility and is separate from proceedings at the International Criminal Court, which concern individual criminal responsibility.

UN Commission of Inquiry — finding of September 2025

On 16 September 2025 the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel published a report concluding that Israel has committed genocide against Palestinians in the Gaza Strip.

The Commission found that Israeli authorities and security forces committed four of the five genocidal acts defined by the 1948 Genocide Convention: killing; causing serious bodily or mental harm; deliberately inflicting conditions of life calculated to bring about destruction in whole or in part; and imposing measures intended to prevent births. On intent, it applied the "only reasonable inference" standard from the ICJ's Bosnia v. Serbia judgment.

Commission Chair Navi Pillay stated: "The Commission finds that Israel is responsible for the commission of genocide in Gaza." The Commission also concluded that President Isaac Herzog, Prime Minister Benjamin Netanyahu and then Defence Minister Yoav Gallant incited genocide. The report covers conduct from 7 October 2023 to 31 July 2025.

Israel categorically rejects the allegation of genocide. Responding to the UN Commission's report, Israel's Foreign Ministry rejected it as "distorted and false" and called for the Commission of Inquiry to be abolished, saying the report relies on Hamas claims.

Israel's stated position is that its campaign is directed at Hamas rather than at Palestinians as a group, that it seeks to minimise civilian harm and to facilitate humanitarian assistance, and that it disputes the independence, evidence and methodology of some investigating bodies.

This section separates four things that are easy to blur together: the text of the law, the court procedure, the findings of investigative bodies, and the positions of governments.

THE CONVENTION TEXT. The 1948 Convention on the Prevention and Punishment of the Crime of Genocide (Article II) defines genocide as any of five acts "committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such": killing members of the group; causing serious bodily or mental harm; deliberately inflicting conditions of life calculated to bring about physical destruction in whole or in part; imposing measures intended to prevent births; and forcibly transferring children. The defining requirement is the specific intent ("dolus specialis") to destroy the group as such — not merely that prohibited acts occurred.

COURT PROCEDURE. Whether that legal threshold is met in this case is for the International Court of Justice to decide on the merits. As of the verification date, it has not done so; the case is in written proceedings (see the ICJ section).

INVESTIGATIVE FINDINGS. Bodies that have found genocide (the UN Commission, Amnesty, B'Tselem) say the specific intent can be established as the only reasonable inference from conduct and official statements. HRW's conclusion is narrower (acts of genocide; intent may be inferred).

GOVERNMENT POSITION. Israel rejects the allegation and says the specific intent has not been established.

HSNet states none of these as its own conclusion. The Convention text is quoted from the treaty; the rest is attributed to the body that said it.

On 5 December 2024 Amnesty International published "'You Feel Like You Are Subhuman': Israel's Genocide Against Palestinians in Gaza", concluding that Israel "has committed and is continuing to commit genocide against Palestinians in the occupied Gaza Strip".

Amnesty states that Israel "has carried out acts prohibited under the Genocide Convention, with the specific intent to destroy Palestinians in Gaza". The research examines the period from 7 October 2023 to early July 2024 and drew on 212 interviews, fieldwork, and visual and satellite evidence.

Note the legal register: Amnesty reaches a finding of genocide itself — not "acts of genocide" and not "may amount to genocide".

Human Rights Watch

On 19 December 2024 Human Rights Watch published "Extermination and Acts of Genocide: Israel Deliberately Depriving Palestinians in Gaza of Water".

HRW concluded that Israeli authorities are responsible for the crime against humanity of extermination, and that the conduct amounts to one of the five "acts of genocide" under the Genocide Convention. On intent it is more guarded than Amnesty: it says genocidal intent "may also be inferred from this policy, coupled with statements suggesting some Israeli officials wished to destroy Palestinians in Gaza", and that the pattern of conduct "may amount to the crime of genocide".

Note the legal register: HRW finds ACTS of genocide and says intent MAY be inferred. That is a narrower conclusion than Amnesty's or the UN Commission's, and HSNet does not present them as equivalent.

On 28 July 2025 B'Tselem published "Our Genocide", the first report by a major Israeli human-rights organisation to conclude that Israel is committing genocide. It states: "An examination of Israel's policy in the Gaza Strip and its horrific outcomes, together with statements by senior Israeli politicians and military commanders about the goals of the attack, leads us to the unequivocal conclusion that Israel is taking coordinated action to intentionally destroy Palestinian society in the Gaza Strip."

Physicians for Human Rights-Israel published a parallel legal-medical analysis concluding the assault meets the criteria for genocide under the Convention. B'Tselem's Executive Director Yuli Novak framed it as a finding of genocide; the significance noted by other coverage is that these are Israeli organisations.
